Terms & Conditions

This Agreement is a contract between the customer (“You”) and Cellarmaster Wines (S) Pte Ltd (Company Reg No. 199101526G), a company incorporated in Singapore and having its registered address at Blk 219 Henderson Road #02-06 Singapore 159556 (“the Company”). 

 Please review the following terms and conditions of use, which govern your use of the site.  By completing the customer registration process and/or placing an order on the Company’s website, you acknowledge that you have read and understood the terms and conditions of this Agreement and agree to be bound by the same. 

 The Company reserves the rights to modify the terms and conditions here in without notice. Your continued use of the website or the services of the Company after any such changes constitutes your agreement to such changes. 

 

1. Registration

You must be 18 years of age or older to register, and to purchase alcohol within Singapore and on the Company’s website. By placing an order on the Company’s website, you confirm that you are at least 18 years old.

By registering an account you agree to provide information about yourself that is true, accurate, current, and complete in all respects.  It is your responsibility to ensure that changes to your personal details are updated immediately.

The Company reserves the right to suspend or cancel your registration. 

If your personal identifiable information changes, or if you no longer desire our services, you may correct, update or request for your personal data to be removed by emailing: admin@cmwines.com.sg.

 

2.Gift Card

 This Gift Card may only be used to make purchases via Cellarmaster Wines Singapore (www.cmwines.com.sg) webstore and is valid for one-time use only. If your order value is higher than the gift card value, you can use a credit card to pay the balance.  Any unused balance on the card will be forfeited.The Gift Card will expire after 12 months from the date of its purchase.It cannot be redeemed or exchanged for cash.

 

3. Intellectual Property

The contents of the Company’s website are protected by copyright, trademarks, database right and all relevant intellectual property rights.  You may retrieve and display the contents of the Company’s website on a computer screen, store such contents in electronic form on disk or print one copy of such contents for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise copy, modify, distribute, transmit, publish, reproduce, repost, create derivative works or in any way use for commercial purposes any of the materials or contents on the Company’s website without its written permission.

 

 4. Accuracy of Content

 The Company shall exercise reasonable care in ensuring that the contents of its website are correct to the best of its knowledge.

 

5. Pricing

 Prices quoted for all Goods and Services are in Singapore Dollars (SGD), inclusive of Goods and Services Tax (GST) and/or Duty. 

 The Company reserves the right to vary the prices of its Goods and Services without notice to you.

 In the event that you are overcharged for any Goods and Services, you shall be refunded the difference within 14 business days.

 In the event that the Company under-priced any Goods and Services, the Company shall not be obliged to provide that Goods and Services to you at the incorrect price.  The Company shall, at its sole discretion, do either of the following:

  1. Contact you and enquire if you wish to cancel your order or continue with the order at the correct price; or
  2. Cancel your order and refund you within 14 business days any payments you have made.

 

6. Availability of Goods

 All orders placed on the Company’s website are subject to the Company’s acceptance of the order and availability of the goods at the time of order.  In the event that the Goods ordered are not available, the Company shall contact you through the means you have provided it at registration to inform you of alternative options.

In the event you choose not to accept our suggested alternatives or change your original order, we will ship out the available items minus the out-of-stock items or cancel the order on your behalf as applicable.

 

7. Your Cancellation Rights

You may cancel your order within 8 hours of placing your order on the Company’s website, provided you have notified the Company before the delivery of the Goods has been made. For order cancellation, please email to orders@cmwines.com.sg or call us at 67665185.

 In the event that your order has been successfully cancelled, the Company shall refund you within 14 working days any payments made with respect to the cancelled order.  For avoidance of doubt, a working day referred to in this Agreement is any day that is not a Saturday, Sunday or Public Holiday in the Republic of Singapore.

 

8. Payment Terms

You shall make full payment for the Goods upon placement of your order on the Company’s website.  Delivery of your order will only be made once full payment for the Goods has been received by the Company.

Orders can be paid through PayPal account, where you would be directed to PayPal for payment to be processed and all credit card details would be provided directly to PayPal.  PayPal is an established and secure payment gateway provider; the Company does not capture any of your credit card details on its website should you make payment through PayPal.

 

9. Ownership 

All Goods shall remain the property of the Company until payment is received in full.
Placing an order on the Company’s website does not constitute a contract.  A contract is made only when the Company accepts your order and have processed your payment.  The Company reserves the right to decline acceptance of your order. 

 

10. Insurance and Liability

The Company shall be responsible for insuring the Goods until the customer’s delivery and/or instructions for receipt have been completed.  Risk of loss of or damage to the Goods passes to you at the time of delivery.

The Company shall not be liable for any fault or deterioration in the Goods it sells to you after its delivery to you as a result of fair wear and tear, wilful damage, accident, negligence by you or any third party, or from your inappropriate handling or storage.

 

11. Risks and Warnings

 You should be aware of the following inherent risks and warnings:

  1. Alcohol should be consumed in moderation and never in conjunction with operating a motor vehicle or machinery. Women should not drink alcoholic beverages during pregnancy because of the risk of birth defects. Alcohol consumption may cause health problems.
  2. A case of wine is heavy, so extra care should be taken when lifting it. If you are concerned about the weight we advise that you transfer the bottles 1 or 2 at a time.
  3. Red wine in particular may cause staining if spilt, so extra care should be taken.
  4. Sparkling wines can be volatile due to the build-up of gasses.  Extra care should be taken when opening these.
  5. Glassware are fragile items.  Please handle with extra care to avoid any injuries or damages.

 The Company shall not be liable for any risks including but not limited to direct, indirect, incidental, punitive or consequential risks that you decide to undertake, save as herein expressly provided otherwise.

 

12. Website Security

 The Company makes all reasonable endeavours to ensure the integrity and security of the server.  The Company do not guarantee that the server will be free from unauthorised use or hacking.

 

13. Additional Terms and Conditions

From time to time, the Company may offer other services, special offers, discounts, or promotions not specifically referred to in the terms and conditions provided herein.   By accepting the services, special offers, discounts, or promotions, you agree to be bound by additional terms and conditions.

Any special offer, sale or bin end wines are offered on a first come first served basis and are non-returnable/refundable/exchangeable. Wines bought from a sale list or bin end selection will not be eligible for any further case discount other than the initial saving shown.

14. Provisions are Severable

Each provision of this Agreement is severable; if any one or more provisions contained in this Agreement shall be deemed invalid, unlawful or unenforceable in any respect under any applicable law, the validity, legality and enforceability of the remaining provisions contained herein shall not in any way be affected or impaired.

 

15. Indemnification

You agree to defend, indemnify and hold the Company harmless from and against any and all claims, damages, costs and expenses, including legal fees arising from or related to your use of this website, or your breach of any representation, warranty, or other provisions of this agreement.

 

16. Force Majeure

Neither party shall be liable to each other for failure in the performance of any of the obligations imposed by the terms and conditions on this website arising from an act of God, war, sabotage, rebellion, riots, hostile activities, interruptions of transportation or inability to obtain necessary labour, materials of facilities, default of any supplier, acts of governmental or quasi-governmental authorities, regulations or restrictions imposed by law, regulations or by court action, fires, explosion, floods, storms or other catastrophes, (whether or not the kind described herein) over which the affected party has no reasonable control and which is of such nature as to make timely compliance impracticable.

 

17. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of Singapore. By accessing this website, you irrevocably submit to the non-exclusive jurisdiction of the Singapore courts.
